Authorization to Publish and Copyright Transfer

This agreement, when completed by the primary author, must accompany any paper offered for publication in the Journal of Directed Energy, but nothing in this document obligates the Journal or its publisher, the Directed Energy Professional Society, to publish the paper.  In the event the paper is not selected for publication or is withdrawn before publication, this agreement is null and void.

AUTHORS:

  The undersigned, primary author of the referenced paper and representing all the authors, desiring to publish the paper in the Journal of Directed Energy, affirms that the paper is original work not published elsewhere and hereby transfers all authors’ copyrights in the above paper to the Directed Energy Professional Society (DEPS).  Persons signing this form affirm that they have obtained or caused to be obtained all appropriate U.S. security, U.S. contracting and/or any employer approvals needed for publication, including consideration of International Traffic in Arms Regulations (ITAR) issues, and will provide documentary proof of such approvals on demand. 

 Returned rights

In return for these rights, DEPS hereby grants the authors and the employers for whom the work was performed, royalty-free permission to

  1. retain all property rights other than copyright, such as patent rights
  2. reuse all or portions of the above paper in other works
  3. reproduce or have reproduced the above paper for the author’s personal use or for company use provided that a. the source and DEPS copyright are indicated,  b. the use of the copies does not imply DEPS endorsement and c. the copies, per se, are not offered for sale
  4. make limited distribution of all or parts of the paper prior to publication
  5. in the case of work performed under U.S. government contract, DEPS grants the U.S. government royalty-free permission to reproduce all or portions of the above paper and to authorize others to do so, for government purposes.

 DEPS obligations

In exercising its rights under copyright, DEPS will make all reasonable efforts to act in the interests of the authors and employers as well as its own interests.  In particular, DEPS will require that

  1. the consent of the primary author will be sought as a condition in granting republication permission to others, and
  2. the consent of the undersigned employer will be sought as a condition in granting permission for others to use any part or all of the paper for promotion or marketing purposes.

 

(If all the authors are U.S. government employees and the work was performed as part of their employment, please check here.  ___  In this case, the paper is not subject to copyright protection, and the signature of the principal author below affirms that the paper is original work not published elsewhere and that all required approvals have been obtained for publication.)
